- interfere with the site's operation, for example by introducing malware or placing an unreasonable load on it.
We may restrict or block access to anyone who breaches these terms.
Content and intellectual property
The text, design, photographs, illustrations, code and other material on this site belong to Expericia or are used with permission, and are protected by copyright and other intellectual-property laws. You may view, download and print pages for your own reference, keeping all notices intact. Any other use requires our prior written consent.
"Expericia" and the Expericia logo are our marks. Client and partner names and logos appear with their permission and remain the property of their owners. Other product and platform names (for example Adobe Commerce, Shopify, Microsoft, Salesforce, Sitefinity) are trademarks of their respective owners; their use here describes the technology we work with and implies no endorsement.
Illustrations marked as such on case-study pages are our own mock-ups and do not depict any client's system or data.
Case studies and information on the site
We try to keep the site accurate and current, but it is general information, not advice, and we may change it at any time without notice. Case studies describe past work as it was delivered; results depend on each client's circumstances and are not a promise of the same outcome for you. Where a project was delivered with a partner agency, we describe the work without naming the end customer. Photographs show our own team and offices.
Nothing on the site is an offer capable of acceptance. Timelines, team sizes and prices mentioned, including the Discovery Sprint fee, are indicative until confirmed in a written proposal.
How our services are contracted
Discovery Sprints, assessments, project work and dedicated teams are provided under a written proposal, statement of work or master services agreement signed by both parties. That document sets the scope, price, payment terms, confidentiality, intellectual-property ownership, warranties and liability for the work, and prevails over these terms. Free assessments carry no obligation on either side and are offered subject to availability.
Submitting a form or booking a call does not create a contract or an obligation on us to provide services.
Enquiries and confidentiality
We treat what you tell us in an enquiry as confidential in the ordinary course of business, but the enquiry form and WhatsApp are not secure channels for trade secrets, credentials or personal data about third parties. Please keep those until we have signed a non-disclosure agreement and agreed a secure way to share them. Our stated response times are targets, not guarantees.
Third-party sites and tools
The site links to third-party services such as LinkedIn, Instagram and WhatsApp, and to our clients' and partners' websites. We do not control them and are not responsible for their content, availability or terms. Using them is subject to their own agreements with you.
Job applications
Applications sent in response to our careers page are considered for the role concerned and, with your agreement, for similar roles. Sending an application does not create an employment relationship. We may verify the information you provide. How we handle applicant data is described in our privacy policy.
Disclaimer
The site is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, about its availability, accuracy or fitness for a particular purpose, and we do not warrant that it will be uninterrupted or free of errors or harmful components. Nothing in these terms limits warranties that cannot be excluded by law or those we give in a signed services agreement.
Limitation of liability
To the extent permitted by law, Expericia will not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising from your use of or inability to use this website. Our total liability for any claim connected with the website is limited to INR 10,000. Liability for services is governed by the relevant services agreement. Nothing here excludes liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot be limited by law.
Governing law and disputes
These terms are governed by the laws of India. Any dispute arising from them or from your use of the site is subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala. If you are a consumer in a country whose law gives you mandatory protections, those protections are unaffected.
Changes to these terms
We may update these terms from time to time. The current version is always on this page with its "last updated" date, and continued use of the site after a change means you accept the updated terms.
